1. Introduction
1.1 Shining Hope (“the Charity”, “we”, “our”, “us”) (ABN 23 905 707 228, Registered Charity Number 22538) is a registered charitable organisation in Western Australia dedicated to suicide prevention, mental‑health support, and bereavement assistance.
1.2 These Terms & Conditions (“Terms”) govern your use of our website, participation in our programmes (Hope House Safe Space [“Safe Space”] and Bereavement Group, and any donations or fundraising activities conducted through us.
1.3 By accessing our site, joining any programme, or making a donation, you agree to be bound by these Terms. If you do not agree, please do not use our services.
2. Eligibility & Acceptance
2.1 You must be at least 16 years old (or the age of majority in your jurisdiction) to register for any online service or to donate.
2.2 If you are under the required age, you may only participate with parental/guardian consent.
2.3 We reserve the right to refuse service, suspend accounts, or reject donations that appear fraudulent, unlawful, or contrary to our mission.
3. Safe‑Space Guidelines
3.1 The Safe Space is a free, confidential environment for any member of the community seeking connection, emotional, or mental‑health support.
3.2 The Safe Space is facilitated by trained volunteers who have lived experience with suicide. Volunteers do not provide professional counselling.
3.3 Participant Responsibilities – All participants must:

Treat every member with respect, empathy, and dignity.

Refrain from harassment, hate speech, or any form of discrimination.

Keep personal identifying information of others confidential unless explicit consent is given.

Consider others in discussion and avoid sharing graphic details of suicide methods or personal suicide experiences in group settings which should be disclosed rather in one‑to‑one private support interactions.
3.4 Shining Hope volunteers reserve the right to intervene where these guidelines are violated. Repeated violations may lead to removal from the Safe Space.
3.5 The Safe Space is not a substitute for professional mental‑health treatment. Participants are encouraged to seek licensed counselling or medical care for clinical needs.
4. Bereavement Group Participation
4.1 The Bereavement Group is facilitated by trained volunteers.
4.2 Members agree to:

Share experiences voluntarily and respect the confidentiality of others.

Follow facilitator instructions and group protocols.
4.3 The Charity does not provide professional counselling; participants should seek licensed mental‑health services for clinical needs.
5. Donations & Fundraising
5.1 We accept donations via credit/debit cardstarough the website, and approved fundraising platforms.
5.2 All contributions will be used solely for charitable purposes outlined in our mission, in accordance with our Charity Collections Licence (WA) and the obligations of a registered charity.
5.3 Donors will receive an electronic receipt for tax‑deduction purposes where applicable under Australian tax law.
5.4 Donations are non‑refundable unless a processing error occurs. In such cases, we will issue a refund within 30 days of the request.
5.5 Any third‑party fundraising event must obtain prior written permission from Shining Hope and comply with the conditions of our Charity Collections Licence and the Associations Incorporations Act 1987 (WA).
6. Intellectual Property
6.1 All content on our website (text, graphics, logos, videos) is owned by Shining Hope or licensed to us.
6.2 You may view and share content for personal, non‑commercial use only, provided you attribute the source.
6.3 Any unauthorized reproduction, distribution, or commercial exploitation is prohibited.
7. Privacy & Data Protection
7.1 We collect personal data (e.g., name, email, donation amount) only to administer services, process donations, and communicate with you.

9. Governing Law & Dispute Resolution
9.1 These Terms are governed by the laws of Western Australia, including the Associations Incorporations Act 1987 (WA), the Charities Act 2013 (WA), and related legislation.
9.2 Any dispute shall be resolved first through good‑faith negotiation. If unresolved, the parties agree to submit to the exclusive jurisdiction of the Supreme Court of Western Australia.
10. Amendments
10.1 We may update these Terms from time to time. Revised versions will be posted on our website with the effective date. Continued use after posting constitutes acceptance of the updated Terms.
